Welcome to ResourceOasis ("we," "us," or "our"). These Terms & Conditions ("Terms") oversee your usage of our yacht charter offerings and our website located at resourceoasis.sbs (the "Service"), which is provided by ResourceOasis.

Engaging with a charter booking or utilizing our Service constitutes your consent to adhere to these Terms. Should you not concur with any part of the terms herein, you must refrain from accessing the Service.

2. Service Overview

ResourceOasis offers a selection of superior yacht charter services which include, but are not limited to:

• Daily yacht rentals
• Sunset cruises
• Corporate retreats
• Private events
• Multi-day charters

We are subject to service availability and weather constraints. We retain the right to alter or cease services without prior notice.

3. Booking and Reservations

3.1 Booking Process

To reserve a charter, one must:

• Be at least 18 years of age
• Supply accurate and comprehensive details
• Remit the required deposit as indicated in your booking confirmation
• Accept these Terms & Conditions

3.2 Confirmation

A booking becomes confirmed once payment has been made and you receive our written confirmation. We maintain the discretion to refuse services to anyone.

3.3 Availability

Charter bookings are contingent upon the availability of vessels and favorable weather conditions. We strive to honor your preferred scheduling whenever feasible.

4. Payment Terms

4.1 Pricing

All prices are presented in € and incorporate all applicable taxes unless stated otherwise. We may adjust prices without prior notification.

4.2 Payment Schedule

• Deposit: 50% of the entire charter cost payable upon booking
• Remaining balance: To be settled 48 hours before the departure of the charter

4.3 Payment Methods

We offer a variety of payment options including major credit cards, wire transfers, and verified cheques. Payments are securely processed through encryption protocols.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• With a notice exceeding 72 hours prior to departure: Full reimbursement minus processing charges
• Notices between 24 and 72 hours prior to departure: A 50% refund
• Less than 24 hours notice prior to departure: Non-refundable

5.2 Weather Cancellations

If our captain deems weather conditions unsafe, we will propose to:

• Rebook your charter for the next available slot without additional costs
• Issue a complete refund if rescheduling isn't possible

5.3 Mechanical Issues

Should mechanical troubles arise with the assigned boat, we will seek to offer an appropriate alternative. In the absence of any such alternatives, a refund in full will be granted.

6. Safety and Conduct

6.1 Safety Requirements

All guests must:

• Heed all commands from the crew
• Wear any provided safety equipment when stipulated
• Disclose any medical conditions impacting their safety
• Stay within approved areas on the vessel

6.2 Prohibited Items

The below items are strictly forbidden on board:

• Glass vessels
• Illegal substances
• Firearms or weaponry
• Pets (subject to prior approval)

6.3 Conduct

Passengers are expected to act respectably. Any conduct jeopardizing safety or disrupting the enjoyment for other guests will result in early termination of the charter without a refund.

7. Liability and Insurance

7.1 Our Liability

We restrict our liability to the amount paid for the charter and are not accountable for:

• Injuries sustained due to passenger negligence
• Property losses or damages
• Unforeseen, incidental, or retributive damages
• Delays due to weather or uncontrolled circumstances

7.2 Insurance Coverage

Our vessels and operations are insured under comprehensive marine policies. However, passengers need to secure their personal and travel insurance.

7.3 Assumption of Risk

Engaging in our charter services signifies your recognition of the intrinsic risks associated with marine activities and you pledge to assume responsibility for your own security and health.

8. Modifications and Itinerary Changes

We reserve the right to adjust itineraries, routes, and schedules owing to considerations like weather, safety, or operational necessities. Attempts will be made to offer suitable alternatives where possible.

9. Force Majeure

Events out of our control, such as:

• Extreme weather conditions
• Natural calamities
• Regulatory ordinances
• Port closures
• Vehicular malfunctions

will not render us liable for any resulting delays, cancellations, or itinerary changes.

10. Privacy and Data Protection

Your private information will be handled in line with our Privacy Policy, which you consent to by utilizing our services.

11. Intellectual Property

All elements of our website, including text, designs, logos, and imagery, are safeguarded by copyright and trademark legislations. Unauthorized reproduction, distribution, or modification is not permitted without explicit permission.

12. Governing Law

The applicable rules in Germany dictate these Terms, and any recourses will take place in courts located in Hamburg, Germany.
